1. Service Description

CallAnswer ("we," "us," or "our") provides an AI-powered answering service designed for home service contractors, including plumbers, HVAC technicians, electricians, roofers, and similar trades. Our service answers incoming calls via AI-generated text messages, qualifies leads, and books appointments on behalf of your business, 24 hours a day, 7 days a week.

By signing up for or using CallAnswer, you ("you" or "Customer") agree to these Terms of Service. If you do not agree, do not use the service.

2. Subscription Terms

Plans and Pricing

CallAnswer offers subscription plans starting at $297/month, with pricing up to $497/month depending on the plan selected. All prices are in US dollars and are subject to change with 30 days' notice.

Free Trial

New customers receive a 14-day free trial. During the trial, you have full access to the features included in your selected plan. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan and your payment method will be charged.

Billing

Subscriptions are billed monthly in advance. Payments are processed securely through Stripe. You are responsible for keeping your payment information current. Failed payments may result in service suspension.

Cancellation

You may cancel your subscription at any time from your account settings or by contacting support@callanswer.net. Cancellation takes effect at the end of your current billing period. We do not provide prorated refunds for partial months.

3. Acceptable Use

You agree to use CallAnswer only to:

  • Answer and respond to legitimate business calls and inquiries
  • Qualify leads and book appointments for your home service business
  • Manage customer communications in a professional and lawful manner

You agree not to use CallAnswer to:

  • Send unsolicited marketing or spam messages
  • Engage in any illegal or fraudulent activity
  • Harass, threaten, or abuse any person
  • Transmit content that is defamatory, obscene, or otherwise objectionable
  • Violate any applicable local, state, federal, or international law

We reserve the right to suspend or terminate your account for violation of these terms.

4. Messaging Consent and TCPA Compliance

CallAnswer sends SMS messages on behalf of your business in response to incoming calls. As the business customer, you are responsible for ensuring that the use of our service complies with the Telephone Consumer Protection Act (TCPA) and all applicable messaging regulations.

Specifically, you acknowledge and agree that:

  • Caller awareness: You are responsible for ensuring that your callers have been informed that they may receive text messages when contacting your business. This can be accomplished through disclosures on your website, voicemail greetings, or other reasonable means.
  • Messages sent through CallAnswer are transactional responses to inbound calls — not marketing or promotional messages.
  • All messages include opt-out instructions. Any recipient can reply STOP to stop receiving messages at any time.
  • Recipients can reply HELP for assistance at any time.
  • Message and data rates may apply to recipients.
  • Message frequency varies based on the conversation.

We will honor all opt-out requests immediately. Once a recipient replies STOP, no further messages will be sent to that number from your business through CallAnswer.

5. AI-Generated Content

CallAnswer uses artificial intelligence to generate text message responses during conversations. While we design our AI to be helpful, professional, and accurate, you acknowledge that:

  • AI-generated responses may occasionally contain inaccuracies
  • The AI acts on behalf of your business based on the information you provide during setup
  • You are responsible for reviewing your conversation logs and correcting any issues
  • CallAnswer is not liable for business decisions made based on AI-generated content

6. Limitation of Liability

To the maximum extent permitted by law, CallAnswer and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, business opportunities, or data, arising out of or related to your use of the service.

Our total liability for any claim related to the service shall not exceed the amount you paid to CallAnswer in the three (3) months preceding the claim.

We do not guarantee that the service will be uninterrupted, error-free, or that all calls will be answered or all leads will be captured. The service is provided "as is" and "as available."

7. Indemnification

You agree to indemnify and hold harmless CallAnswer from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the service, your violation of these terms, or your violation of any applicable law or regulation, including but not limited to the TCPA.

8. Termination

Either party may terminate this agreement at any time. You can cancel your subscription through your account settings or by contacting us.

We may suspend or terminate your account immediately if you violate these terms, use the service for illegal purposes, fail to pay, or if we determine that your use of the service poses a risk to us or other users.

Upon termination, your access to the service will end at the conclusion of your current billing period (for voluntary cancellations) or immediately (for termination due to violation). You may request export of your data within 30 days of termination.

9. Modifications to Terms

We may update these Terms of Service from time to time. We will notify you of material changes via email at least 30 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the updated terms.

10. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved in the courts located in Delaware.
